Terms of Service Moana Rd Online Store Effective as of 16 December 2025

  1. Introduction Welcome to Moana Rd. These Terms of Service (“Terms”) apply to your use of the website www.moanaroad.co.nz (the “Site”) and the purchase of products through the Site. By placing an order, you agree to be bound by these Terms. If you do not accept these Terms, please do not use this Site.

  3. Use of the Site 3.1 You must be 18 years or older or have legal permission from a guardian to make purchases. 3.2 You may use the Site for legitimate shopping purposes only. Any unauthorised use is prohibited. 3.3 We reserve the right to amend, suspend or discontinue the Site (or any part) without notice.
  4. Products & Availability 4.1 All products on the Site are subject to availability. If a product is unavailable after you place your order, we will notify you and refund any payment you made for it. 4.2 We attempt to display colours, designs and imagery of products as accurately as possible. However, actual products may vary slightly.
  5. Order Process 5.1 When you place an order you will receive an order confirmation email. This does not mean we have accepted your order — acceptance occurs when we dispatch your order and you receive a dispatch confirmation. 5.2 We may refuse or cancel an order at our discretion (for example, if there was an error in the product description or price, or payment cannot be authorised). 5.3 Pricing and shipping charges are as stated on the Site at the time you place your order.
  6. Pricing & Payment 6.1 Prices on the Site are in New Zealand dollars (NZD) and include GST. 6.2 Payment must be made using the available payment methods. Payment will be processed at the time of order confirmation.
  7. Shipping & Delivery 7.1 We offer free standard shipping for orders over NZ$50 within New Zealand, excluding oversized items. Oversized items incur shipping charges calculated at checkout. International shipping rates apply as shown. 7.2 Delivery times are estimates only and commence from dispatch. We are not liable for late delivery beyond our control (e.g., carrier delays). 7.3 Risk in the products passes to you upon handover to the carrier (international orders) or upon delivery (NZ orders). Title to the goods passes to you once we have received full payment.

Returns, Exchanges & Refunds Please refer to our detailed Returns Policy for full information on damaged/faulty items, change-of-mind returns, and refunds. 8.1 Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (CGA) for New Zealand consumers. 8.2 Faulty or damaged items: – New Zealand customers: Entitled to CGA remedies (repair, replacement, or refund – your choice where applicable). – International customers: We offer a voluntary full refund (item price + original shipping) – no return or replacement required. 8.3 Change-of-mind returns: Accepted only for New Zealand customers within 30 days, subject to conditions (unused, original packaging; buyer pays return shipping). 8.4 Refunds are processed promptly after approval.
  9. Consumer Guarantees & Liability 9.1 If you are a consumer (as defined in the CGA), nothing in these Terms restricts your rights under the CGA. 9.2 To the fullest extent permitted by law, our total liability to you for any loss or damage arising under or in connection with your order (whether in contract, tort or otherwise) will be limited to the purchase price paid by you for the relevant product.
  10. Intellectual Property All content on the Site—including text, graphics, images, logos, designs and product packaging—is owned or licensed by Moana Rd. You may not copy, reproduce or use any content from the Site without our prior written consent.
  11. Governing Law & Dispute Resolution These Terms are governed by the laws of New Zealand. Any dispute arising from or in connection with these Terms or your order will be resolved in the New Zealand courts, unless we otherwise agree.
  12. Amendments We may amend these Terms at any time by posting a revised version on the Site. The revised Terms will apply to orders placed after the effective date shown. It is your responsibility to review the Terms before placing each order.
